THERE IS A KING BED IN THE MASTER BEDROOM, TWO TWINS WITH TRUNDLE BEDS IN (TOTAL OF 4 TWINS) THE SECOND AND A LOFT WITH A QUEEN SLEEPER SOFA. From $1600 weekly. Available daily, weekly, or monthly. Plus taxes and fees. IMPORTANT NOTICE: We have no damage or signs of any oil on our beaches at this time. We are on the East Atlantic Coast in Volusia County and the Gulf Stream is over 40 miles out from our shore which should provide protection from the Gulf oil spill. However, I will guarantee a full refund of deposit or rents if your planned visit has to be canceled due to an actual environmental issue involving this oil spill. RULES AND REGULATIONS Reading this agreement online and booking a unit constitutes a contract between the person(s) herein and Beach Realty Center; to rent the dwelling described in this Agreement. List all houseguests. THE RENTER UNDERSTANDS that we accept families, married couples, and responsible adults over the age of 25 only. You certify that you have read the limitations placed on the number of persons permitted to occupy the premises, and agree to abide by such limitations: if not, you will be asked to leave with NO REFUND. Only those people who are listed are allowed on the property. If guests are invited, Beach Realty Center, Inc. must approve them. If we find there are excessive persons staying on the property, above and beyond those who have registered, your RESERVATION SECURITY DEPOSIT & RENT PAYMENT WILL NOT BE RETURNED. No fraternities, school or civic groups are allowed. ABSOLUTELY NO PARTIES ALLOWED. IDs must be furnished if requested. Renter understands that by Florida law, the legal drinking age is 21 years old. A minor in possession of alcohol is a misdemeanor in the State of Florida and punishable by law to include severe fines, community service and certified record of any incident under misdemeanants name. The Sheriffs Department has the authority to be called to a residence and investigate if there are any suspicions of minors drinking or possessing alcohol. Violation of the above is grounds for immediate eviction. NO REFUNDS. ALL UNITS ARE NON-SMOKING! All homes and condos are Non-smoking! No exceptions complete loss of rental deposit AND immediate eviction. COMPLIANCE WITH RULES AND REGULATIONS: Renter shall take all reasonable steps to see that he/she members of his/her family and other occupants of the Premises adhere to the rules and regulations applicable to the Premises. Failure to do so may lead to the forfeiture of the Security Deposit. The occupancy of the Premises and the use of community walkways and common areas shall be sufficiently quiet and peaceful so as not to disturb others. Parents are responsible for the behavior of their children. THERE SHALL BE ABSOLUTELY NO NOISE AFTER 10:00 PM. CHECK-IN / OUT TIME: Upon receipt of your payment, your Reservation conformation will be emailed or mailed to you. After full payment is made instructions will be given on how to obtain keys to your unit. Check-In is after 2:00 P.M., Check-Out is 10:00A.M. Renter and Renters entire party must vacate the property and leave the keys at the Office or Office drop box at Beach Realty Center, 508 E. 3rd Ave., New Smyrna Beach, FL. by 10:00A.M. Failure to check out on time could result in a $50-$100 late fee. For lost keys, $50 will charged. For lost pool tags, Parking Pass or ID Badges $20 per tag will be charged. Locked out of Room Charge $50.00. Lost Garage Door Remote or Coded Key $100.00. All homes and condos are cleaned and inspected upon your departure and the cost is included in you total rental fee. Late Check-Outs / Check-outs after 11:00 A.M. will be charged for a day, departures later than 5:00 P.M. will be charged a full day rate. If you would like a late checkout please make arrangements with Beach Realty Center 24 hours before departure time. Late departure cannot be allowed if a guest is arriving. SUBSTITUTION OF COMPARABLE ACCOMMODATIONS. No specific property is guaranteed to Renter. Beach Realty Center has the right to substitute a property of equal value. SECURITY DEPOSIT & DAMAGE Renter agrees to indemnify Owner and/or Beach Realty Center for any damages to the Premises and to the furnishings, equipment and household items therein, which occur during Renters occupancy excluding normal wear and tear. Renter hereby authorizes Beach Realty Center to charge the credit card for the of repairs, replacement, services, telephone charges or extra cleaning for all damages, breakage and/or loss incurred during his/her stay. In the event of the damage to the premises, its equipment, furniture, or carpeting, Renter shall be responsible for damage costs exceeding the security deposit, including collection costs and attorneys fees. Documentation detailing damages and charges will be provided to the guest. If a renter is evicted by the management or the local law enforcement, no refund of rent fee or security will be made. PET POLICY Pet Policy is set by each owner and/or by the Condo association also may have limits on pets and pet weights. Additional security maybe required by some units. Condo associations can evict your pet if it does not meet their rules. You must pick up after you pet in all areas. PETS are allowed on this Premise. All pet must be registered by breed and weight and must be current with shots and vaccinations or a breech of contract. LONG DISTANCE TELEPHONE CALLS. Renter shall NOT charge any long distance telephone calls to the telephone on Premises. Renter may, of course, charge such calls to his personal or business credit card or telephone. ENTRY OF PREMISES. Agent or an authorized employee or repairman may enter the Premises during customary hours of business (such limitation not to apply in cases of emergency) for any purpose connected with repair, improvement, care and management of the Premises. If the property you are renting is for sale, we reserve the right to show this property to prospective buyers with 24 hours prior notice to you. UNFORSEEN CIRMUMSTANCES. Beach Realty Center, Inc. is not responsible for circumstances beyond his control that may render your rental unavailable, either prior to your arrival or during your stay. These circumstances include, but are not limited to: water damage, mechanical failures, if unit is being sold, owner decides not to rent, renovation, construction, etc. In any case, Beach Realty Center, Inc. will use their best effort to find another property for you in the area. The rate quoted for this reservation is not guaranteed to be the same if it should become necessary to move you to another property, if available. TERMINATION OF RENTAL. If renter violates any of the conditions or restrictions of this Agreement, Owner may terminate this Agreement and enter the Premises. Upon notice of termination of this Agreement, Renter shall vacate the Premises immediately. FURNISHINGS. Renter understands that the Premises and its furnishings are privately owned. Neither the Agent nor the Owner shall be responsible for providing any additional furnishings or equipment not specified in the literature. The individual Owners have completely furnished their rental units with all the necessities. They want you to enjoy their Florida home as they do. Please treat their possessions as you would your own. ACCUMULATION OF LAUNDRY. Maid cleanup service includes no more than two loads of laundry. For each additional load of laundry will be $20.00 charge against your Security Deposit. Housekeepers do not wash dishes. All dishes must be cleaned before departure. (Dishes may be left in dishwasher but cleaned) Failure to leave apartment in a neat, orderly condition will result in the forfeiture of the Security Deposit. We cannot accept responsibility for aesthetic conflicts. OWNERS CLOSET. One closet in the Premises may be reserved for storage of the Owners personal property and it is not included with the rental. LOST OR STOLEN ARTICLES. Agent and Owner are not responsible for Renters articles lost, stolen or left behind on or in the Premises. CANCELLATION POLICES All cancellations are subject to a $75.00 cancellation fee. A written notice of cancellation must be given by mail or e-mail at least 90 days prior to arrival, monthly reservations, and 30 days prior to arrival for less than a month reservation. If the cancellation notice is received within the specified time stated above, the balance of the rental deposit will be refunded less a $75.00 administrative fee. All other cancellations will forfeit the total rental fee paid to date. A notice of cancellation must be in the form of an email or letter form. Please use an e-mail program that requires a delivery and read receipt for your protection. If by mail request a Return Delivery Receipt. If you do not receive a Cancellation Confirmation within your cancellation schedule time please notify Beach Realty Center immediately 386-428-1212. Should the owner of any property elect to remove, sale and/or any other reasons remove their property from our rental program; the guest shall not hold Beach Realty Center liable. In such an instance, the guest will be relocated to a comparable accommodations determined by Beach Realty Center. If comparable accommodations are not available, the guest will receive a full refund. Any reservation obtained under false pretense shall be subject to forfeiture of advance payments, deposit and/or rental money, and the party won't be permitted to check-in. POOL. Use of the pool is limited to renter and registered guests only. We cannot guarantee that the pool, will be heated at your condominium, but we will make every effort to appraise you of your condominiums particular guidelines concerning heating of the pool and relevant pool regulations. (This is for units that this applies to only.) MAINTENANCE Any maintenance items should be reported directly to Beach Realty Center during the course of normal business hours. DO NOT CALL INDIVIDUAL CONDOMINIMIUM MANAGERS OFFICE. In the event of an emergency after hours call 386-428-1212. If Medical Emergency call 911! In case of appliance failure, same day repair service cannot be guaranteed, but every effort will be made to provide service as quickly as possible. *NOTE: Tenant shall not be entitled to any refund for inoperative appliance, air conditioner, hot tub, or swimming pool. Agent, however, upon being notified by tenant of any malfunction, will make every responsible effort to have such appliances, air conditioners and hot tubs promptly repaired. If cleaning is not to the standard of the guest it must be reported within first day of stay and a cleaner will be sent back to the unit to resolve the issue. Should the pool be unusable for any reason, Owner assumes no responsibility and such occurrence shall not constitute sufficient cause for a refund of Renters monies. Replacement or repair of television cannot be guaranteed. In accepting this rental, I agree to be responsible for any damage caused by my party or guests. I also agree to register all overnight guests and agree to abide by the condominium or house rules and regulations.
